Incentive Terms & Conditions

Definitions:

'Promotor' means Westcoast Limited T/A Data Select, incorporated and registered in England and Wales with company number 01816587, whose registered office is Arrowhead Park, Arrowhead Road, Theale, Reading, Berkshire, RG7 4AH.
'Product' means any applicable Samsung product, service or solution as set out in the ‘Points’ section of this Website.
'Incentive' means this incentive comprising of the purchase of Products subject to these Terms and Conditions.
'Reseller' means a UK B2B reseller who is a member of Samsung One and procures Products via their trading account with the Promoter to participate in the Incentive.
'Prize' means the reward awarded to the winning Reseller as a result of purchasing the Products and participating in this Incentive.
'Website' means https://www.subscribepage.com/abudhabi
‘Samsung One’ means Samsung’s B2B Partner Programme which Resellers must be enrolled into to enter the Incentive.
'Personal Data', 'Data Controller' and 'Data Processor' shall all have the meaning set out (i) the General Data Protection Regulation ((EU) 2016/679) and (ii) the Data Protection Act 2018, and for both as amended or updated from time to time.

Terms and Conditions

Participation in the Incentive is subject to the Reseller’s acceptance of the Terms and Conditions set out below. By completing the registration process on the Website you are agreeing to the Incentive Terms and Conditions.
Incentive Summary: Once successfully registered with this Incentive, all purchase orders for Products that are placed by the Reseller and fulfilled by the Promoter during the Incentive Period will contribute towards the Reseller’s Incentive Requirements (as defined below). Each Reseller will be placed into a table determined by their Samsung One status (ie Registered, Authorised, Advanced, Elite).
Eligibility: This Incentive is only open to Resellers and only Products purchased from the Promoter count towards the Incentive. This Incentive is designed to reward the highest performing salesperson within the Reseller, and the Promoter reserves the right to refuse any proposed Reseller salesperson put forward to represent the Reseller on the trip if deemed necessary. Any salesperson that the Reseller proposes to represent them on the Prize must have completed all of their Samsung One training modules to be entitled to attend the Prize.
Incentive Period: The Incentive will run from 09:00 Monday 11 September 2023 until 18:00 Wednesday 31 January 2024.

How to win:  To qualify for a chance to win the Prize, a Reseller must satisfy the following conditions during the Incentive Period ("Incentive Requirements”):

1. A Reseller must purchase sufficient Products to meet their points target, as specified in the Points section of the Website.
2. Only Products purchased after the Reseller has registered onto the Incentive will count towards the Incentive Requirements.
3. The Resellers who have achieved the highest number of points versus their points target in each Samsung One status will qualify, with the following number of places available in each Samsung One status:
  a. 3 x Resellers in Elite,
   b. 3 x Resellers in Authorised,
  c. 3 x Resellers in Advanced,
  d. 12 x Resellers in Registered.
4. Having satisfied the Incentive Requirements, Resellers will be awarded one Prize place for which they may propose one salesperson to represent them on the Prize. Any salesperson that the Reseller proposes to represent them on the Prize must have completed all of their Samsung One training modules to be entitled to attend the Prize.

Prize: A three-night trip to Abu Dhabi including flights, accommodation, sustenance and activities. The event will be hosted by the Promoter.

Data Protection: For the purposes of this Incentive, the Reseller and Promoter agree that the Promoter shall act as a Data Processor when processing the Personal Data of the Reseller and its representatives, with the Reseller being the Data Controller. The Promoter shall only process the Reseller’s Personal Data in connection with the operation of the Incentive and shall do so in accordance with its Privacy Policy available at: https://www.dataselect.com/privacy-policy/

General: It is the sole responsibility of the Reseller and their representatives to ensure that they have appropriate authorisation to participate in this Incentive and that they are eligible/entitled to receive personal gifts under the terms of their employment. The Promoter will have no liability whatsoever to the Reseller for any claims arising from such breaches. The Prize is only available on the date stipulated by the Promoter and is non-transferable, non-exchangeable and no cash alternative is available. The Promoter may substitute a Prize of equal or greater value if required. The Promotor reserves the right to alter, amend, suspend, withdraw, or terminate this Incentive with immediate effect at any time without prior consultation. The Promoter reserves the right at its absolute discretion to disqualify from this Incentive without prior notice any Reseller whom it (i) considers has not complied with these Terms and Conditions or (ii) reasonably believes has interfered with the fair running of the Incentive. The Promoter is not responsible or liable for any technical fault of any kind that prevents or obstructs the Reseller from participating in the Incentive. Insofar as is permitted by law, the Promoter will not have any liability whatsoever to the Reseller for any injuries, losses, costs, damage or disappointment of any kind resulting in whole or in part, directly or indirectly from the Prizes awarded by participation in this Incentive, or otherwise. Nothing in this clause shall limit any liability in respect of death or personal injury arising out of the Promoter’s negligence or fraud. By entering into this Incentive, you agree to be bound by these Terms and Conditions. The Promoter will not cover any tax and National Insurance contributions applicable to the Reseller through the Reseller’s acceptance of any Prize (value circa £4,800) earned through successful participation in the Incentive. The Incentive and these terms and conditions shall be governed by, construed, and interpreted according to English law and shall be subject to the exclusive jurisdiction of the English Courts.
